ADA Grievance Committee

The ADA Grievance Committee was established to provide an equitable resolution of complaints alleging any action prohibited by the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973, as amended (29 U.S.C. 794). The Committee investigates complaints of discrimination on the basis of disability in the provision of services, activities, programs, or benefits by Stafford County in accordance with the County's ADA Grievance Procedures.

The Committee is composed of a minimum of five (5) members consisting of one member from the architectural or structural engineering profession; two members who are individuals with a disability as defined by the ADA; and two members-at-large. Members shall serve without monetary compensation and shall continue to serve until replaced. The current members of the ADA Grievance Committe are:

This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 (“ADA”). It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by Stafford County. The Stafford County’s Personnel Policy governs employment-related complaints of disability discrimination.

The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.

The complaint should be submitted by the grievant or his/her authorized representative as soon as possible but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, the ADA Coordinator or his designee will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, the ADA Coordinator, or his designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio tape. The response will explain the position of Stafford County and offer options for substantive resolution of the complaint.

If the response by the ADA Coordinator or his designee does not satisfactorily resolve the issue, the complainant or his authorized representative may appeal the decision within 15 calendar days after receipt of the response to the ADA Grievance Committee.

Within 15 calendar days after receipt of the appeal, the ADA Grievance Committee will meet with the complainant to discuss the complaint and possible resolutions. The Committee may have one (1) fifteen (15) day extension of time to meet with the complainant after notification to the complainant. Within 15 calendar days after the meeting, the ADA Grievance Committee will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint

All appeals received and responses given by the ADA Coordinator and the ADA Grievance Committee will be retained by Stafford County for at least three years.


Meetings

The date, time and place of Committee meetings shall be designated by the Chairman, most usually when the Chair has been notified of a grievance that should be heard. There shall be an annual organizational meeting held in January, or as soon thereafter as reasonably possible based upon the Board of Supervisors' appointment cycle. 

The next meeting will be held on Tuesday, October 24, 2022, at 6:00 p.m. in the Community Development Service Center (CDSC) Conference Room on the 2nd floor of the George L. Gordon, Jr. Government Center, 1300 Courthouse Road  Stafford, VA  22554
