Emergency and Hazardous Chemical Inventory (Tier II Reporting)

Section 312 of EPCRA requires facilities that possessed any OSHA hazardous chemical above certain threshold amounts for at least a 24-hour period to submit a Tier II Report. The threshold for OSHA hazardous chemicals is 10,000 pounds, except for Extremely Hazardous Substances (EHS) chemicals whose threshold quantity is 500 pounds or the Threshold Planning Quantity (TPQ) of that EHS, whichever is lower. TPQ’s for EHS chemicals can be found on the EPA List of Lists.

What is a hazardous chemical?

Hazardous chemicals are substances for which a facility must maintain a SDS under the OSHA Hazard Communication Standard, which lists the criteria used to identify a hazardous chemical. SDSs are detailed information sheets that provide data on health hazards and physical hazards of chemicals along with associated protective measures. Over 500,000 products have SDSs which are normally obtained from the chemical manufacturer.

How do I submit a Tier II Report?

Facilities covered by these requirements must submit an emergency and hazardous chemical inventory form to the Local Emergency Planning Committee (LEPC) annually. Tier II forms require basic facility identification information, employee contact information for both emergencies and non-emergencies, information about chemicals stored or used at the facility, and additional data elements which would be useful to local planners and responders. 

Tier II Reports are due annually on March 1 of every year. Reports are for the preceding calendar year. For example, a Tier II Report submitted on March 1, 2023, should be reporting all Tier II chemicals stored on site for the year of 2022. Facilities must use the EPA's Tier2 Submit software to create their Tier II reports.

As of June 1, 2023, Tier II submissions will only be accepted via the George Washington Regional Commission (GWRC) LEPC Tier II Portal. No Tier II submissions will be accepted via email, traditional mail, or any other delivery method after June 1, 2023.  It is recommended that you click on the “Help & Support” button in the middle of the page for tutorials and videos about the submission process.


Per the GWRC LEPC, submitting your “.t2s” file to the GWRC LEPC Tier II Portal fully satisfies your EPCRA mandate for submitting to all State and local agencies including the SERC, your local LEPC, and your local Fire Departments.
